Sunshine Aupairs Terms and Conditions

At the time that you (‘the client’) have given us (Henica t/a Sunshine Au Pairs & Nannies)   electronic instruction to match you with a suitable au pair or family, this shall constitute acceptance by the client of the Sunshine Au Pairs & Nannies Terms and Conditions of business as set out below.

No fee is payable for the client to register on the Sunshine Au Pairs & Nannies website. Once registered the clients profile and information therein becomes the property of Sunshine Au Pairs & Nannies and you grant Sunshine Au Pairs & Nannies the right to use the information contained within that profile in perpetuity for such reasonable purposes as it sees fit. Such purposes may include but not be limited to marketing & statistical analysis. You must own the copyright to any image you upload to the website. We do not sell your personal information to third parties however personal information collected may be transferred and shared in the event of a sale of this website to another company or person.

The service we offer

No fee is payable for you to register on the Sunshine Au Pairs & Nannies website. When you have filled in our registration form profile will be created that can be viewed by other visitors to the website. If you wish to contact another user you can do this by paying a fee to upgrade your membership. You will then have the ability to email an unlimited number of other users.  
Your membership upgrade will last for 30 days. We will contact you prior to the expiration of your membership and provide you with a link to renew your membership. If you do nothing your membership will lapse. Your profile will still be visible on the website even if your membership has lapsed. If you want to deactivate your account you should contact us by email deactivate@sunshineaupairs.co.uk

Payment of fees

Membership can be paid for by PayPal or credit or debit card services provided by PayPal. The current membership fee is displayed on the website before we ask you to provide any payment details. We do not store your credit or debit card details. We comply with the Association Rules of Visa USA Inc ‘Visa’ and Mastercard International Incorporated ‘Mastercard’.
We do not make automatic renewals of membership. We will contact you prior to the expiration of your membership and you provide you with a link to renew if you so wish. You will be required to resubmit your payment details. If you do nothing your membership will lapse.

Refunds

Refunds of membership fees will not be made. Before you submit your payment details please ensure you understand the service we offer in exchange for your membership fee.
Compliance with Data Security requirements
We agree to comply with all applicable laws and regulations, including, without limitation, the Data Protection Act 1988 and the guidance by the UK Information Commissioner.

Use of the Sunshine Au Pairs & Nannies website

This website is for use by persons of  the age of 16 years old and over. The only personal contact detail we will request at any time is your email address. You agree not to upload any contact information including but not limited to email address, telephone number or personal web page address in any part of the site where the information has not been specifically requested.

Restrictions on your use of the website:  

You must not abuse, threaten, harass, intimidate, impersonate, slander or libel any other user, or employee, or the Sunshine Au Pairs & Nannies website itself.

You must not use the Website for any illegal, unintended, unauthorized or unacceptable purpose.

You must not add any content, of any type, to your collections that is obscene, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, libellous, illegal, or otherwise inappropriate.

You must not use the site for commercial purposes without our prior consent , use the website to create or send any unsolicited email ("spam") to any user of the website or external party, use the website to transmit worms, viruses or any other code of a destructive or deceptive nature. For example, you may not include worms, viruses or any computer code of a destructive or deceptive nature in your registration that may affect the website.

Persons who have been convicted in any jurisdiction of any criminal offence in the last 5 years are prohibited from using this website. Persons who have been convicted in any jurisdiction of any sexual offence in the last 20 years are prohibited from using this website

Provision of service

Whilst we will do our best to maintain the operation of our services it may be affected by factors outside our control. We cannot guarantee constant fault free access to the site at all times. We are not liable to you as a result of any loss you may incur from an inability to access the website. If we are unable to maintain operation of our services we will credit you with one full day’s access for every day or part-day that you cannot access the site. You must request this by email help@sunshineaupairs.co.uk within 7 days of the date when you could not access the service.

Liability

Sunshine Au Pairs & Nannies provides its clients with the ability to contact each other after the payment of a fee to upgrade their membership. It is not an au pair agency and any arrangements entered into between Clients  re between those persons directly, it cannot be held responsible for any losses arising to clients from an au pair placement howsoever caused.

Sunshine Au Pairs & Nannies accepts no liability of any kind for any inconvenience, loss or damage of property, or any loss or injury howsoever arising directly or indirectly from any act or omission of any applicant introduced to the client by Sunshine Au Pairs & Nannies even if such an act or omission is negligent, fraudulent or dishonest.

Sunshine Au Pairs & Nannies does not monitor the content of this website and cannot be held responsible for any incorrect information posted on this website. The final responsibility for any decision to employ the au pair rests with the client who is strongly advised to check documentation and references personally; Sunshine Au Pairs & Nannies does not offer any warranty as to the suitability, honesty, character or capability of any Applicant.

We cannot be held liable for any indirect or consequential loss whatsoever.

Termination of agreement

You may terminate your membership at any time by emailing us at this email address. deactivate@sunshineaupairs.co.uk

Sunshine Au Pairs & Nannies may terminate your membership at any time if you have not adhered to the terms and conditions set out in this document. We will notify you by email to the email address you submitted when you registered.

Amendment

This agreement may be amended by us at any time. We advise you to check back from time to time. This version is dated 23.02.09  

Third party rights

Without exception a person who is not party to this agreement has no right to enforce or enjoy any of the benefits of this agreement.

Governing law and jurisdiction

This agreement is governed by English law. The parties submit to the non-exclusive jurisdiction of the courts of England and Wales

Sunshine Au Pairs & Nannies will determine what constitutes violation of our terms at our sole discretion. We may take any action available to us, including issuing a warning to you, deleting your account, blocking your access to our service or legal action.
